Sadiq-Shammi’s candidature is cancelled, Shamim Haque’s valid

The Appellate Division has also upheld the decision to cancel the candidature of independent candidate Serniabat Sadiq Abdullah of Barisal-5 seat and Awami League candidate Shammi Ahmed who is discussed in Barisal-4 seat. As a result, they are unable to participate in the 12th National Assembly elections. However, the Appellate Division has ruled that the candidature of Awami League nominated candidate Shamim Haque in Faridpur-3 constituency is valid.

On Tuesday, the 6-judge appeal bench led by Chief Justice Obaidul Hasan gave this order.

Faridpur district Awami League advisory council member and independent candidate AK Azad filed an appeal seeking cancellation of Shamim Haque’s candidature on the charge of dual citizenship. After the hearing, the Election Commission canceled Shamim Haque’s nomination papers on December 15.

Shamim Haque filed a writ in the High Court against this decision and the High Court rejected it on December 18. Later, on December 19, when he appealed to the Appellate Division to return his candidature, the Chamber Court suspended the order of the High Court and returned his candidature. Later AK Azad appealed again against it.

Meanwhile, the Awami League nominated candidate of the same constituency, Colonel Zahid Farooq, filed an appeal seeking cancellation of Serniabat Sadiq Abdullah’s candidature on the charge of dual citizenship.

Pankaj Debnath, an independent candidate of that seat, complained to the returning officer against Shammi Ahmed.
